Terms & Conditions

These terms are the agreement between you and Kapture when you use this website, hire our services, buy from the Kapture Store, enrol in the Academy, attend our Events or join the Kapture Network. We wrote them to be read. Read them.
1. Acceptance of these terms
By using rodneymanyepa.com, submitting a form, placing an order, buying a ticket, enrolling in a course or applying to the Network, you accept these Terms & Conditions. If you are acting for a company or organisation, you confirm you have authority to bind it. If you do not accept these terms, do not use the site or our services. These terms incorporate our Privacy Policy, Cookie Policy and Refund Policy.
2. Who we are, and definitions
"Kapture", "we", "us" and "our" mean Kapture of The Kapture Studio, Harare, Zimbabwe — the creative ecosystem founded by Rodney Manyepa, including Kapture Studio, Kapture Digital, Kapture Academy, Kapture TV, Kapture Records, the Kapture Network, the Kapture Store, Kapture Events and Awards, and Kurongeka OS. "You" means the person or entity using the site or our services. "Deliverables" means the work products we create for you under an accepted proposal.
3. Services and proposals
Every Kapture project follows the same process, and these terms follow it too:
- Brief. You tell us what you need — via the contact page or in person. A brief is an invitation to discuss, not a contract.
- Proposal. We respond with a written proposal: scope, deliverables, timeline and price. A proposal is valid for 30 days unless it says otherwise.
- Deposit. Work begins when you accept the proposal and pay a 50% deposit. Acceptance plus deposit forms the contract for that project.
- Build with reviews. We build, you review at the checkpoints set out in the proposal. Feedback rounds beyond those agreed may be quoted as additional work.
- Launch. Final deliverables are released on payment of the balance.
Timelines depend on you as well as us: delays in providing content, feedback or approvals extend deadlines accordingly. Changes to scope after acceptance are agreed in writing and may adjust price and timeline.
4. The Kapture Store — digital products
Digital products (templates, workflows, stock media, motion assets, books, audiobooks and similar) from the digital library are sold under a single-business licence: you may use the product in and for one business, in unlimited projects for that business. You may not resell, redistribute, sub-license, share or repackage the files — whether modified or not — and you may not claim authorship of the underlying asset. Delivery is by instant download after payment. Faulty files are replaced or refunded within 7 days as set out in the Refund Policy; otherwise digital sales are final once downloaded.
5. The Kapture Store — physical goods
Physical goods (merch, devices, studio equipment, furniture and similar) from the physical store are ordered as follows: you place an order and pay a 50% deposit; we procure or prepare the goods; you inspect the goods before paying the balance; the balance is paid on approval and the goods are delivered or collected. Cash on delivery is accepted where offered. Risk in the goods passes to you on delivery or collection; ownership passes on payment in full. Product listings marked "launch catalogue" describe our opening range, and availability may vary — we will confirm availability and final pricing before taking your deposit. 6. Kapture Academy — courses and certification
Academy enrolment gives you personal, non-transferable access to the course materials for the access period stated at enrolment. Course materials are for your own learning: no sharing of logins, no redistribution of lessons, templates or briefs. Certificates are issued on completion of the stated requirements, including any assessments, and certify completion of a Kapture Academy course — they are our own certification and we do not represent them as government or university qualifications. We may update course content to keep it current. A 14-day cooling-off period applies to course purchases as set out in the Refund Policy.
7. Events and tickets
Tickets for Kapture events admit the named holder or a person the ticket is transferred to — tickets are transferable, so if you cannot attend, someone else may take your seat. Tickets are refundable up to 7 days before the event; if we cancel an event, you receive a full refund. We may change speakers, venue or programme where reasonably necessary; a change of city or date entitles you to a refund. We may refuse entry or remove attendees whose behaviour endangers or seriously disrupts others, without refund. Recordings: events may be photographed and filmed; by attending you consent to appearing incidentally in event media. If you object, tell the crew on the day and we will take reasonable steps to exclude you from published material.
8. Kapture Network — accounts and acceptable use
The Kapture Network connects talent with bookers. When you apply for or hold a Network profile, you agree that:
- Everything in your profile — identity, skills, portfolio, credits — is true and yours. Misrepresentation is grounds for removal.
- You will honour bookings you accept, and communicate promptly and professionally when circumstances change.
- You will not use the Network to harass, discriminate, spam, scam or solicit off-platform payment in breach of an agreed booking's terms.
- You are responsible for keeping your account credentials confidential and for activity under your account.
We may suspend or remove profiles that breach these rules. Bookers and talent contract with each other for the booked work; where Kapture facilitates the booking, our role and any fees are stated at the time of booking.
9. Kurongeka OS
Kurongeka OS is our operating platform for websites, stores, bookings, events, courses, CRM and marketing. Where we build and operate a Kurongeka OS deployment for you, the scope — including training and the one-month post-launch support period — is defined in your proposal under section 3. You retain ownership of your business data held in your deployment. Demo access to the dashboard on this site is provided for evaluation only, with sample data, and carries no service commitment.
10. Payment terms
We accept Ecocash, Innbucks, Visa, Mastercard, PayPal and cash. Unless a proposal says otherwise: services are 50% deposit up front and 50% on completion before release of final deliverables; Store digital products are paid in full at checkout; Store physical goods follow the deposit-inspection-balance process in section 5; monthly packages (such as content packs) are payable in advance each month. Prices are stated in United States dollars unless indicated otherwise. Overdue balances may result in paused work or withheld deliverables until settled.
11. Intellectual property
Your work: on payment in full, you own the final deliverables we created for you — your logo, your brand assets, your website content — for use in your business without limit, unless the proposal states a specific licence instead.
Our work: Kapture retains ownership of our pre-existing materials, methods, templates, code libraries, and the Kurongeka OS platform itself, along with drafts and rejected concepts. You receive a licence to anything of ours embedded in your deliverables, sufficient for their normal use.
Portfolio: we may show completed work in our portfolio and marketing unless your proposal includes a confidentiality clause. The Kapture, Kurongeka and Rodney Manyepa names, wordmarks and site content belong to us — do not copy, scrape or imitate them.
Your materials: you warrant that content you supply for a project (text, images, audio, marks) is yours to use, and you are responsible for claims arising from materials you supplied.
12. Warranties and limitation of liability
We warrant that services will be performed with professional skill and care. Except as expressly stated, the site and its content are provided "as is", and we do not warrant that the site will be uninterrupted or error-free. To the maximum extent permitted by law: we are not liable for indirect or consequential loss, loss of profit, revenue, data or goodwill; and our total liability arising from any project, order or ticket is limited to the amount you paid us for that project, order or ticket. Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud.
13. Indemnity
You agree to indemnify Kapture against claims, losses and costs arising from your breach of these terms, your misuse of the site or the Network, or materials you supplied for a project infringing someone else's rights.
14. Termination
You may end a services engagement by written notice; you remain responsible for work done and costs committed to that date, as set out in the Refund Policy. We may end an engagement or suspend access to the site or Network if you materially breach these terms and do not remedy the breach within 14 days of written notice — or immediately for serious misuse. Sections 4 (licence limits), 11 (intellectual property), 12 (liability) and 13 (indemnity) survive termination.
15. Governing law
These terms are governed by the laws of Zimbabwe, and the courts of Zimbabwe have jurisdiction over disputes arising from them — though we will always try honest conversation first. If you are a consumer in another jurisdiction, you keep any protections granted by mandatory local law; we additionally honour GDPR-style data rights for international visitors as described in the Privacy Policy. If any provision of these terms is found unenforceable, the rest remain in force.
16. Changes to these terms
We may update these terms as the ecosystem grows. Updates are published on this page with a new "Last updated" date. Changes do not apply retroactively to orders or projects already accepted. Continued use of the site after an update means you accept the revised terms.
